انسانی شدن حقوق محیط زیست در پرتو کرامت انسانی

Abstract:
حقوق بینالملل محیط زیست از جمله شاخههای حقوق بینالملل است که در چند دهه قبل به خصوص از دهه 1970 رشد و توسعه یافته است. چند دهه گذشته فرایند انسانی شدن حقوق بینالملل نیز آغاز و به شاخههای مختلف آن تسری یافت. انسانی شدن حقوق بینالملل ابتدا از رویکردی فردمحور متعاقبا رویکردی بشریتمحور به خود گرفت. بدین معنا که بدنبال تحقق هدفهای عالی مشترک در میان کل بشریت میباشد. حقوق بینالملل محیط زیست از جمله شاخههای حقوق بینالملل است که تحت تاثیر این فرایند قرار گرفته و با توجه به عوامل عینی و ذهنیِ موجود در فضای زیستمحیطی، دارای رویکردی بشریتمحور میباشد. به نظر نگارنده آنچه منجر به انسانی شدن حقوق محیط زیست و رویکرد بشریتمحور در آن شده است نفوذ مولفه‌های کرامتی با استناد به کرامت انسانی در حوزه حقوق محیط زیست و ظرفیت‌هایی است که مفهوم کرامت انسانی از آن برخوردار است.
